Who these terms cover

These terms are the deal between you and Tech and Mech USA LLC, a Florida company based in Orlando.

They cover techandmech.com, the free tech audit and every service we sell. “We” and “us” mean Tech and Mech. “You” means the person or business using the site, asking for an audit or paying us.

Using the site, sending a note for an audit or paying an invoice means you accept these terms. If your quote or your written guarantee says something different on a point, that writing wins on that point. If a court sets one part aside, the rest still stands.

What you can do with the free audit

The audit is free and yours to use inside your business. It is not yours to resell or republish.

You can do the work in it yourself, have your staff do it, or hire anyone you like to do it, us included. You can’t sell it, post it, publish it, turn it into a product or service for other businesses, or present it as your own work. The same goes for every document, roadmap and strategy we make for you.

If you hire someone to do the work, share the audit with them for that job only. These limits apply to them too, and you are responsible if they break them.

What the audit is, and what it is not

The audit is a snapshot of what we found on the day we looked. It is not a promise, and it is not legal, tax or financial advice.

We build it from public information, the details you give us and our own tools, including AI, with a person checking the work. Search results, maps and competitors change every week, so parts of it can go out of date or turn out wrong. Check anything that matters with your own accountant, lawyer or advisor before you act on it.

Results are not promised

Nobody can promise what your phone, your search position or your revenue will do, and we don’t.

Results depend on your market, your competitors, your prices, how fast you answer the phone, and platforms like Google that neither of us controls. Any number we show you, including the calculator on our home page, is an estimate, never a promise.

When you act on our advice, the decision and the result are yours. The only promise we make about results is the written guarantee in section 7.

How billing works

The build is billed in two halves. The monthly plan bills automatically on the 1st of each month.

Half the build fee is due before work starts and the other half when your new site is built. The monthly plan is charged in advance on the 1st, to the card or account on file. Your price is the one in your quote, and it does not include any taxes that apply.

Money paid for work already done is not refunded, except as the guarantee in section 7 says. If a payment fails, we tell you. If it stays unpaid, we can pause the work until it is paid.

Starting and stopping

Start with four months and the guarantee, or go month to month with no guarantee.

The four-month start is a minimum: the four months are owed even if you stop sooner. After that, or from day one if you chose month to month, you can stop in any month. Email [email protected] before the 1st and that month is not billed. The build fee applies either way.

We can also end the work with written notice, for example when invoices go unpaid or these terms are broken.

The guarantee

On the four-month start, if the system has not paid for itself by month five, months two to four are free.

Month one is the build. Months two to four are for growing, ranking and tweaking. On the first day of month five we compare the revenue the system brought in with what it cost, and check that the profit covered it.

You get the guarantee in writing before the first invoice, with the starting baseline and how revenue is counted. Once that is signed, neither side moves the target, and the written version is the one that counts. Month to month from day one carries no guarantee.

What the monthly hours cover

The monthly plan buys hours of our team, spent on whatever we judge will move your business forward.

There is no fixed task list and no list of promised deliverables. You can always tell us what matters most to you. We never post your social or run your ads.

What you are responsible for

We can only work with what you give us, so the details, access and approvals are on you.

Give us accurate information, the logins we ask for (Google, your domain, your hosting and the like) and answers in good time.

Anything you send us to use, such as photos, logos, reviews and text, must be yours to use. If someone claims it isn’t, you cover our costs from that claim. The rules, permits and advertising claims of your own business are yours to keep right.

Who owns what

You own the domain, site, logins and data from day one.

Everything we build for you as a paying client is yours: the site, the content, the accounts and the tools. Work that has not been paid for stays ours until it is. We keep the general know-how and building blocks we use for every client, and we can keep using them.

When you leave, our part ends: no more maintenance, hosting, storage, backups or monthly charges. If your site or tools sit on our hosting, move them before your last paid month ends. Ask, and we hand over the files and logins you need.

Showing the work we did for you

We may show the work we did for you. We never show your private numbers.

That means your business name, screenshots of your site and tools, and public reviews, in our portfolio and marketing. Revenue, call counts and other figures stay private unless you say yes in writing. If you want out of the portfolio, email us and we take it down.

Other companies’ services

Your site runs on companies neither of us controls. Their changes, outages and decisions are not ours.

That includes Google, hosting companies, domain registrars, payment processors, booking tools, plugins and AI tools. If one of them goes down, changes its rules or prices, or suspends an account such as a Google Business Profile, we help where your hours allow, but we are not responsible for what they did.

Our team

Please don’t hire our people out from under us.

While you work with us and for 12 months after, don’t hire or contract any of our employees or contractors directly without our written OK.

Keeping things private

What you share with us stays private, and so does what we share with you.

We use your logins and business details only to do your work. You keep our pricing, our methods and the documents we make for you private, as section 2 says. How we handle personal information is in our privacy policy.

Limits on what we owe

If something goes wrong, the most we owe is what you paid us in the three months before it happened.

We are not responsible for lost profits, lost sales, lost data or other indirect losses, even if we knew they could happen. The site and our work are provided as they are, with no promises beyond the ones in these terms and your written guarantee. These limits apply as far as Florida law allows.

If we disagree

Talk to us first. Most things get sorted out on a call.

Email [email protected] with what is wrong and give us 30 days to fix it or work it out. If we can’t, Florida law applies and the case goes to the courts in Orange County, Florida.

Changes to these terms

We may update these terms, and the date at the top will show when.

If a change affects what you pay, we tell you before it applies to you. Using the site or our services after a change means you accept it.

How to reach us

Questions about these terms go to a person, not a ticket queue.

Email [email protected], or call or text (407) 276-3042, Monday to Saturday, 8 am to 8 pm Eastern. Written notices under these terms go to that email address.
